1. DEFINITIONS


1.1 “Client” is the person, firm or corporate body to whom the EZ MANPOWER Introduces a Candidate.

1.2 “Candidate” is the person Introduced by the EZ MANPOWER to the Client for work/ job.

1.3 “Introduction” means the interview of a candidate in person, online, or the passing of a CV.

2. OBLIGATIONS OF EZ MANPOWER


2.1 EZ MANPOWER shall use reasonable endeavours to introduce one or more suitable Candidates to meet the requirements of the Client for a given vacancy. EZ MANPOWER cannot guarantee to find a suitable Candidate for every vacancy. EZ MANPOWER shall use reasonable efforts to ascertain that the information provided by EZ MANPOWER to the client in respect of the Candidate is accurate.

2.2 EZ MANPOWER accepts no responsibility in respect of matters outside its knowledge and the client must satisfy itself as to the suitability of the candidate.

3. CANDIDATE OBLIGATIONS


3.1 The candidate shall furnish genuine documents, genuine references and updated CV's.

4. CLIENT OBLIGATIONS


4.1 The client should satisfy itself as to the suitability of the Candidate. The client is responsible for providing work permits, arrangement of medical examinations, and satisfying other requirements such as qualifications or permission required by law of the country in which the candidate is hired to work.

4.2 The client must provide to EZ MANPOWER details of the position which the Client seeks to fill, including the type of work that the candidate is expected to do, the location, hours of work, the experience, training, qualifications and any authorisation which the client considers necessary or which are required by law or any professional body of that country, for the candidate to possess in order to work in the position, and any risks to health or safety known to the client and what measures the client is taking to prevent/ control such risks.

4.3 The client must provide details of the date the client requires the Candidate to begin work, the duration of the work, minimum rate of remuneration, expenses and any other benefits that would be offered, the intervals of payment and the length of notice that the candidate would be entitled to give and receive to terminate the employment with the client.

5. CHARGES/ FEES


5.1 The client and candidate shall pay EZ MANPOWER the fee for its services, as per the terms agreed upon. In case of non payment, EZ MANPOWER reserves the right to seek legal action to recover its dues.

6. LIABILITY AND INDEMNITY


6.1 EZ MANPOWER shall not be liable under any circumstances for any damage, expense, loss, costs or compensation which may be incurred by the client that is in any way connected with EZ MANPOWER seeking/ introducing a candidate for the client or from the failure of EZ MANPOWER to introduce any candidate.

7. APPLICABLE LAW


7.1 This User Agreement shall be construed in accordance with the applicable laws of India. The Courts at Mumbai shall have exclusive jurisdiction in any proceedings arising out of this agreement.
